PURCHASE OF PRODUCTS

Orders

We will take all reasonable care, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

The contents of the contract/order will be stored at/with Molloys Furnishers, where we keep this data in confidence according to our Privacy Policy. As an additional security measure, no credit/debit card details submitted online are stored directly by us once your order has been processed.

Contract Creation and Electronic Contracts

The technical steps required in creating the contract between you and us are as follows:

  • You place the order for your products on the website by completing the check-out process, which you will be guided through by a series of simple instructions/prompts.

  • You will have the opportunity to change your order up until you select to ‘Place your Order’.

  • Once payment has been authorised we will contact you to confirm that your ordered has been processed and advise you on an approximate delivery date.

  • We will contact you when the goods arrive in our warehouse confirming that delivery arrangements need to be made. Order acceptance and the completion of the contract between you and us will take place on the dispatch to you of the products ordered, unless we have notified you that we do not accept your order or you have cancelled it in accordance with our terms and conditions.

It is recommended that you retain all e-mails relating to you order/contract.

Non-Acceptance of your Order may be a result of one of the following:

  • The product you have ordered is unavailable from stock.

  • We are unable to obtain payment authorisation.

  • We have found a pricing or product description error.

  • You live outside of our delivery areas

  • Your failure to meet the eligibility to order criteria set out in the Contractual Capacity terms and conditions section.

The contract will be concluded in English.

If we do cancel you order/contract we will notify you by e-mail and will refund to you any sum paid to us by you (in respect of the current order/contract) as soon as possible and in any event within 30 days of the cancellation of your order. We will not be obligated to offer any additional compensation for any inconveniences suffered.

Contractual Capacity

To be eligible to purchase products on this website and lawfully enter into and form contracts on this website under English law you must: - Register by providing your real name, phone number, e-mail address, payment details and other requested information. Be over 18 years of age. Stipulate a delivery address in the United Kingdom. Please note that PO box numbers, hotels and accommodation addresses are not acceptable.

Description of Products

Each product purchased is sold subject to its description which sets out additional specific conditions related to the product. Including, without limitation, terms and conditions concerning estimated delivery times and aftercare service. We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time of publishing when the relevant information was entered onto the system. Images are for illustration purposes only and should not be relied on for colour and size.

Payments

Molloys Furnishers does not hold or store any card data supplied by the user, as all payments are carries out through a secure payment gateway to provide the user with the utmost security. We are also fully PCI compliant. All prices are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. The total cost of your order is the price of the products ordered plus delivery charges. Payment can be made by any of the methods specified in the payment/confirmation section of this website and payment will be debited and cleared from your account upon order. You confirm that the credit or debit card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.

Refusal of Transaction

We reserve the right to withdraw any products from this website at any time and/or remove or edit any materials or content on this website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from this website whether or not that product has been sold; removing or editing any materials or content on the website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

By making an offer to buy a product, you specifically authorise us to transmit information (including any updated information) or to obtain information about you from third parties from time to time, including but not limited to your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.

DELIVERY

Our deliveries are carried out by 1-2 men who will ensure that the furniture is delivered, unwrapped, set up and positioned as required. We can also include a phone call up to 2 hours before delivery to ensure that the delivery can be carried out successfully if requested.
We take pride in our delivery service and aim to ensure that all products are delivered within the allotted timescale. It is your responsibility to advise us at the time of ordering your furniture of difficulties that may be encountered when delivering to your property, by ensuring that you inform us of any specific details or requirements upon the time of your order. You can do this by calling in-store on 01704 535204 or by e-mail at sales@molloysfurnishers.co.uk quoting your order reference number and your address/postcode. Safe access through your home, to the room of choice, must also be considered ensuring that the route is clear.

All delivery times given by us are approximate. We always give delivery times in good faith but cannot be held responsible for any direct or indirect loss due to any reasonable delay/delays due to unforeseen circumstances outside of our reasonable control.

Delivery charges vary depending on the type of product ordered, the service you select and the area in which the delivery address is located

If for any reason goods are not paid for in full prior to delivery, the goods remain the property of Molloys Furnishers until fully paid.

CANCELLATION RIGHTS & RETURNS POLICY

Cancellation (before Delivery)

Under the Distance Selling Regulations, UK consumers have the legal right to cancel  their order within seven working days of receipt of their goods  Where good are delivered to a third part, you will only be able to exercise this right if you are able to return to us the goods you ordered.

Items  from  Stock

If, after having placed your order for an item that is in-stock, you have a change of heart you may cancel your order at any time prior to delivery. All you need to do in contact us/the member of staff who processed your order on 01704 535204 or e-mail us at sales@molloysfurnishers.co.uk. This also applies to click & collect items that are in-stock.

Once we acknowledge receipt of you cancellation, you will receive a full refund using the same method as your original payment.

Bespoke Items, Made to order or Special Orders

If the items ordered are not from our stock, we will have commissioned a supplier to make them/it specifically for your order. Unless we receive your written notification to cancel within seven working days of your first acknowledgement e-mail, we reserve the right to charge the direct cost to us for the return of the goods.

Returns (After Delivery)

The following returns policy is applicable to website and telephone orders only (for in-store purchases please speak to a member of our Sales Staff). In compliance with the Distance Selling Regulations you have a cooling off period, where you may withdraw your order and therefore your agreement with us. The cooling off period is any time up to seven working days after the day we have delivered the product to you. You must cancel your order in writing either by fax, letter or email.

If the goods are returned for any other reason that being defective then you will be required to arrange and pay for the cost of returning the goods to us, alternatively we will collect the goods and reserve the right to charge you the direct cost of collection.

The product must be in its delivered form and must not have been tampered with in anyway. Where applicable it is advised that you use the original packaging to protect the product for its return journey. Once with us, the product will be inspected to ensure the product has not been tampered with in any way and is complete.

Once the product is with us, has been inspected and the return is confirmed, you will receive a full refund using the same method as your original payment.

Please note;
For hygiene reasons pillows, duvets and mattresses with opened packaging cannot be returned/cancelled unless in accordance with your legal rights. (For example; if the product was confirmed as defective by us) Bespoke Items, Made to order or Special Orders If your products are bespoke, made to order, special orders or even purchased in bulk they are not subject to the cooling off period outlined in the Distance Selling Regulations, we will have commissioned a supplier to make the specifically for your order.

Unless we receive your written notification to cancel within seven working days of you receiving our first order acknowledgement email, we reserve the right to charge the direct cost to us of the return of the goods.

CONCLUSION OF A CONTRACT

This website and the prices shown constitute an invitation to trade and not an offer capable of acceptance. At all times our acceptance of an order takes place on despatch of the order, at which point the purchase contract will be made. Molloys Furnishers reserves the right to cancel any order at its discretion and at any time before the point of despatch, including for technical reasons.
